Philadelphia’s ban on asking salary history was set to take effect on May 23, 2017 however, with the city’s agreement, a federal judge has issued a stay on the ban.
In an attempt to close the gender pay gap, Mayor Jim Kenney signed the bill in January. The bill has come under scrutiny by big Philadelphia corporations, like Comcast, and by the Chamber of Commerce for the Greater Philadelphia Area, which has now filed a lawsuit against the ban. The Chamber requested an injunction and the city of Philadelphia will hold off on enforcing the ban until Judge Mitchell Goldberg rules on that motion.
In the meantime, employers can continue asking applicants about their salary history. However, employers will want to observe how this develops to remain compliant should the stay be lifted or the injunction request denied.
